1. The "Meta & Third-Party Billing" Shield
Third-Party Integrations and Associated Costs: Labeib provides a software interface to connect with third-party services, including but not limited to the Official Meta WhatsApp Cloud API.
- Direct Billing: By enabling the WhatsApp integration via Embedded Signup, you acknowledge that you are entering into a direct billing relationship with Meta Platforms, Inc.
- Zero Liability for Usage Costs: Labeib is strictly a software provider and assumes absolutely no liability for any fees, charges, overages, or penalties incurred through your Meta Business Account. You are solely responsible for monitoring your WhatsApp message volume and paying Meta directly for all API usage.
- Account Suspension: Labeib is not responsible if Meta restricts, suspends, or bans your WhatsApp Business Account due to violations of Meta's Commerce or Messaging policies, or due to unpaid balances.
2. Account Security and Unauthorized Access
You are entirely responsible for maintaining the confidentiality of your Labeib account credentials and any connected third-party accounts (e.g., your Facebook Business Login).
- Client Responsibility: You agree to immediately notify Labeib of any unauthorized use of your account. Labeib will not be liable for any losses or damages arising from your failure to secure your credentials.
- Compromised Integrations: If your account is compromised and unauthorized parties use your Labeib dashboard to send WhatsApp messages or extract lead data, you remain solely responsible for any resulting third-party API costs or data privacy violations. Labeib provides the platform "AS IS" and disclaims liability for data breaches resulting from user negligence.
3. Artificial Intelligence Output and Accuracy
Labeib utilizes advanced Artificial Intelligence (AI) to interact with your customers and summarize conversations.
- No Guarantee of Absolute Accuracy: While we restrict the AI to your provided product catalog, AI systems can occasionally generate inaccurate, incomplete, or unintended responses ("hallucinations").
- Final Verification: You agree that you are responsible for reviewing AI-generated summaries and interactions. Labeib, Mad Trek, and its affiliates are not liable for any lost sales, customer disputes, or financial damages resulting from inaccurate statements made by the AI digital promoter.
4. Acceptable Use and Anti-Spam Policy
You agree to use Labeib's messaging features (including WhatsApp and Email automation) strictly for transactional, customer-initiated, or explicitly opted-in communications.
- You may not use Labeib to send unsolicited bulk messages (spam).
- You must adhere to all local and international data privacy laws (e.g., GDPR, CCPA, PDPL) regarding lead capture and communication.
- Violation of this policy grants Labeib the right to immediately suspend or terminate your account without a refund.
5. Maintenance and Scheduled Downtime
To ensure optimal performance, security updates, and regular bug fixes, Labeib reserves scheduled maintenance windows.
- Scheduled Window: Routine maintenance is scheduled for Saturday mornings (Arabia Standard Time / KSA Time). During these periods, you may experience brief interruptions or downtime. We will make reasonable efforts to minimize disruption.
- By using the service, you acknowledge that Labeib is not liable for any missed interactions, data delays, or perceived losses during these stated maintenance windows.
6. Indemnification and Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Labeib, Mad Trek, its resellers, or its affiliates be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or relating to the use of, or inability to use, this service.
You agree to defend, indemnify, and hold harmless Labeib and its team from any claims, damages, obligations, losses, liabilities, costs, or debt arising from: (a) your use of the platform; (b) your violation of any third-party right, including Meta's terms of service; or (c) any claim that your use of the platform caused damage to a third party.
7. Data Retention & Deletion
In compliance with data protection laws, we enforce clear retention periods for the data processed on behalf of our clients:
- Lead Data: Personally Identifiable Information (PII) such as names, phone numbers, and emails collected through kiosks and catalogs are retained for the duration of your active subscription, plus a 90-day grace period post-cancellation, after which PII is anonymized or removed.
- Conversation Data: Chat transcripts and AI-generated summaries are retained for a maximum of 24 months from creation, after which they are automatically purged.
- Account Deletion: Users may request account deletion at any time. Accounts enter a 30-day restorable soft-delete window, followed by permanent hard deletion.
8. Data Ownership
You (the company/client) retain full ownership of all lead data, conversation history, and analytics collected through your use of the Labeib platform.
- Processor Role: Labeib acts strictly as a data processor. We do not sell, share, or monetize your lead data.
- Data Export: You have the right to export your data (leads and sessions) at any time during your active subscription or the 90-day post-cancellation window.
9. AI Data Processing
To power the digital promoter experience, Labeib relies on third-party Large Language Models (LLMs).
- Zero Retention by Third Parties: Conversation data sent to our AI providers (e.g., OpenAI) is processed in real-time and is explicitly opted out of being used for training their public AI models.
- Internal Storage: The resulting AI summaries and conversational insights are stored securely within Labeib's own infrastructure (hosted in Germany) and are governed by our standard retention policies.
